1. PREAMBLE AND SCOPE

This Refund and Cancellation Policy (“Policy”) governs the relationship between Devithor AI Space Private Limited (“Company”, “we”, “us”) and any individual or entity (“User”, “Student”, “Parent”) who purchases a subscription, digital product, or examination access on the website https://devithoraispace.in/ or the skchallenge platform.

By making a payment on our platform, you acknowledge that you have read, understood, and agreed to be bound by this Policy. This document is designed to be read in conjunction with our Terms and Conditions and Privacy Policy.

2. DIGITAL PRODUCT NATURE & “NO REFUND” RULE

The Company specializes in digital educational content, including but not limited to SaaS tools, online examination modules, digital study materials, and subscription-based access to the skchallenge dashboard.

• Non-Tangible Goods: Unlike physical goods, digital products are delivered instantly via server-side access or download links.

• Finality of Sale: Once a payment is successfully processed and access to the digital product or subscription is granted to the user’s account, the sale is considered final.

• Usage-Based Restriction: Because our products are intellectual property that can be consumed immediately, we operate under a Strict No-Refund Policy. This is to prevent the unauthorized exploitation of our talent-based examination materials and proprietary software.

3. EXCEPTIONS: ELIGIBILITY FOR REFUNDS

While we maintain a strict no-refund stance, we recognize specific technical or administrative errors where a refund may be considered at the Company’s sole discretion:

A. Duplicate Payments

If a user is charged twice for the same subscription or product due to a technical glitch in the payment gateway (e.g., Zoho Flow or third-party processors), the Company will refund the duplicate amount.

• Requirement: The user must provide transaction IDs for both payments within 48 hours.

B. Technical Failure to Deliver

If a user pays for a subscription but is unable to access the skchallenge platform due to a server-side error on our Hostinger servers that lasts for more than 7 consecutive days, and our technical team is unable to resolve it, a pro-rated refund may be issued.

C. Unauthorized Transactions

In the event of fraudulent use of a user’s credit/debit card, we will cooperate with the bank and the user. However, refunds in such cases are typically handled through the bank’s “chargeback” process.

4. SCHOLARSHIP & EXAMINATION FEES

As mentioned in our Terms, Devithor AI Space Private Limited conducts merit-based talent exams for student knowledge.

• Registration Fees: Fees paid for participating in skchallenge exams or scholarship assessments are strictly non-refundable, regardless of whether the student attends the exam or not.

• Result Disputes: Refunds will not be granted based on dissatisfaction with exam results or failure to qualify for a scholarship. Scholarship eligibility is determined solely by the Devithor AI Space Private Limited Examination Rules.

5. CANCELLATION OF SUBSCRIPTIONS

Users have the right to cancel their future subscriptions at any time:

• Procedure: Users can cancel their subscription via their dashboard on https://devithoraispace.in/ or by emailing devithoraispcce@gmail.com.

• Effect of Cancellation: Cancellation stops future billing cycles. However, the user will continue to have access to the platform until the end of the current paid billing period. No partial refunds will be given for the remaining days in a month or year.

6. PARTNER & SERVICE PROVIDER PAYMENTS

In accordance with our internal Partner Agreements:

• Payments made to partners, co-directors (such as S. Allah Rakha Nazeer), or service providers are governed by separate commercial contracts.

• Once a commission or partner payment is disbursed based on the agreed-upon milestones, it is non-reversible unless a manual error in calculation is identified within 7 days.

7. PROHIBITED CONDUCT & FORFEITURE

The Company reserves the right to terminate any user account without a refund if the user is found:

1. Attempting to copy, record, or distribute our copyrighted YouTube or website content.

2. Engaging in “Gaming or Gambling” activities using our name or platform.

3. Cheating or using AI tools to manipulate skchallenge exam results.

4. Engaging in any activity that violates the laws of Telangana or India.

In such cases, all remaining subscription balances will be forfeited as a penalty for breach of contract.

8. REFUND PROCESSING TIMELINES

If a refund is approved by our management team:

• Verification: It takes 5–7 business days to verify the claim.

• Disbursement: Approved refunds are processed back to the original payment method (Credit Card, UPI, or Bank Account).

• Bank Timelines: It may take an additional 7–10 business days for the amount to reflect in your statement, depending on your bank’s policies.

9. MODIFICATIONS TO THIS POLICY

Based on the evolving requirements of our educational services, Devithor AI Space Private Limited reserves the right to modify this Refund and Cancellation Policy at any time. Any changes will be updated on this page. Users are advised to check this policy before every purchase.

10. JURISDICTION

Any dispute arising out of this Refund Policy shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts in Mahabubnagar, Telangana.
